Abstract
"This essay advocates for the criterion that the payment of
royalties for mining activities should be structured in the same way as it is done
for medium-scale mining. This change in structure is in response to the need to
ensure the application of constitutional principles of proportionality, equality, and
free competition in mining law. This is seen as a safeguard to enable companies
in Ecuador to maintain a sustainable balance, thereby ensuring their own
existence in the market and the connected production chain. It is necessary and
urgent to propose a reform to the mining law."
Description
Este ensayo defiende el criterio de que el pago de las regalías a la
actividad minera debe esquematizarse bajo la misma estructura que lo hace
para la mediana minería. Este cambio de estructura responde a la necesidad
de garantizar la aplicación en la ley de minería de los principios
constitucionales de proporcionalidad, igualdad y libe competencia, esto como
una garantía para que las compañías en el Ecuador puedan mantener un
equilibrio sostenible, y con ello garantizar su existencia propia en el mercado y
de la cadena productiva que esta vinculada a la misma. Es necesario y urgente
plantear una reforma a la ley de minería.
