“ANÁLISIS DE LA PRUEBA DE OFICIO FRENTE A LA OBLIGACIÓN DE LA CARGA DE LA PRUEBA, EN LOS PROCEDIMIENTOS DEL CÓDIGO ORGÁNICO GENERAL DE PROCESOS”

Abstract

In the following academic work, the possible existence of a contradiction between: the regulations in probative matters of the operative principle and the ex officio test as jurisdictional faculty of probative initiative were analyzed. In this sense, qualitative research was carried out based on the doctrine, norm and comparative law of Colombia and Peru, with the aim of deepening the institution of the ex officio or informal test, its characteristics, its basis and its nature. Thus, obtaining that such legal axiom as the principal director of civil proceedings in the Ecuadorian adjective rule must be assessed under a separation as regards the operative principle and the principle of providing evidence; as well as develops in the norm, both organic and constitutional, within our legal system. Under these premises, ex officio evidence does not find opposition within the procedures governed under the operative principle, but acquires a character of complementarity as a legal tool that is endowed to the judge to fulfill his role. However, it is noted that the aforementioned tool must be understood correctly, its origin must be deepened, with the aim that this is regulated by the legislator in order to encourage the correct use of it without abusing the right or causing deviations that distort this legal institution.
