Abstract
This paper analyzes the relationship between the imprescriptibility of the crime of embezzlement (peculado) in Ecuador and the right to be tried within a reasonable time from a constitutional and Inter-American perspective. The study starts from the recognition that Article 233 of the Ecuadorian Constitution establishes the imprescriptibility of certain crimes against public administration as a mechanism to combat corruption and prevent impunity. However, this rule must be interpreted in harmony with due process guarantees, particularly the right to a reasonable time recognized in the Constitution and the American Convention on Human Rights. Through a qualitative legal-dogmatic approach, the research examines the normative framework, national and Inter-American jurisprudence, and relevant doctrinal contributions. The study concludes that the imprescriptibility of criminal action does not allow indefinite proceedings and must be balanced with the State’s obligation to ensure diligent investigations and timely judicial decisions within the constitutional rule of law.
