In Ecuador, administrative procedure is a legal mechanism through which the public administration exercises its powers and makes decisions that affect those subject to its jurisdiction. With the enactment of the Organic Administrative Code, the power to obtain evidence ex officio was included within the procedure; however, it lacks formal limits for this action by the Public Administration, which conflicts with the essential principles of due process. The objective of this study is to analyze the legal limits of ex officio evidence in Ecuadorian administrative procedure since its implementation in the Organic Administrative Code, in order to determine its compatibility with the principles of due process, impartiality, and legal certainty, and to establish criteria to guide its correct application. Through a descriptive legal study model, the main finding is that ex officio evidence in the administrative sphere should be governed by guiding criteria such as exceptionality, justification, the guarantee of full adversarial proceedings, relevance, and compatibility with the principle of party autonomy.
