| dc.description | El Ecuador sigue la tradición romanista del derecho, desarrollándolo en un sentido estrictamente positivista; sin embargo, a lo largo de la historia se ha desarrollado el sistema del precedente jurisprudencial, que dentro de esta misma corriente nunca tuvo una importancia trascendental como fuente de derecho. Empero, la jurisprudencia en el Ecuador poco a poco ha ganado reconocimiento en las cortes, y esto ha llevado a que el principio de igualdad sea la piedra angular mediante la cual avanza el derecho ecuatoriano, pues las decisiones de los jueces están sujetas a una homogeneización con la que se garantiza el trato igualitario de las personas que acceden a la justicia, ya que los casos análogos ahora son tratados de la misma manera, sin importar el carácter subjetivo de cada uno. Por esto, el sistema de precedente se ha desarrollado como una manera de afianzar la igualdad en el sistema judicial. | es |
| dc.description.abstract | Ecuador follows the roman tradition of the law, which leads us to develop it in a strictly positivist sense. Nevertheless, through history the precedent system has been developed, which has never had a transcendent importance in positivism as a source of law. However, the jurisprudence in Ecuador has slowly gained entrance in our courts and the precedent system has developed as a way to guarantee equality in the judicial system. The principle of equality is the cornerstone by which the ecuadorian law moves forward, because the decisions of the judges are subject to a homogenization that guarantees equal treatment of all citizens accessing the justice system, due to all the analogous cases being treated in the same manner, regardless of the subjective character of each case. For this, the precedent system has been developed as a way to secure equality in the judicial system. | es |
