Abstract

This paper examines the implementation of testamentary trusts in Ecuador, highlighting the outdated inheritance law provided for in the Civil Code. Currently, Ecuadorian law strictly protects compulsory heirs and limits the conditions that can be imposed in a will. Although these limitations seek to secure the heir’s best interest, at the same time they restrict the testator's freedom to plan their succession efficiently. Against this dispute between freedom of will and the protection of compulsory heirs, the testamentary trust has emerged as a very viable resource. Countries such as Colombia and Mexico allow a custodian (trust) company to manage and distribute assets after the testator's death, under clear rules and respecting the rights of the legitimate heirs. Its practice has shown advantages in securing assets, ensuring the continuity of family businesses, and reducing inheritance disputes. This research highlights how specific reforms to the Civil Code or the Stock & Securities Market Law would solve the current struggles, offering clear balance between the protection of inheritance rights and the local need of estate planning being more efficient in an increasingly complex social and economic context.
