In this paper, the intention is to analyze The Legal Antinomy on Aids to Navigation (ALN) and its impact on the level of Operational Availability at the waterway to the Maritime Port of Guayaquil - Ecuador through a review of legal theories, principles and by experts questionnaire in order to determine the limit of responsibility, clarity y objectivity of Guayaquil Port Authority (APG) and Ecuadorian Navy/ Oceanographic and Antarctic Institute of the Navy (FN/INOCAR) and a correct ALN level of Operational Availability. The antinomy is identified in two legal rules of APG and FN/INOCAR about the competence of ALN "management" which prevents a correct ALN "maintenance”. At July 2023, 46.4% of level of Operational Availability was registered at the waterway to the Maritime Port of Guayaquil - Ecuador due to deficient maintenance by APG, which is evidenced by a contradiction of existing regulations that does not allow timely action by FN/INOCAR as a specialized entity for said competence by law. Finally, it is suggested that APG donate, transfer or cede the active asset of ALN to the FN/INOCAR, which would include the allocation of resources so that the competence of "management" by FN/INOCAR is fully fulfilled and the entire legal regulation system of ALN at the waterway to the Maritime Port of Guayaquil - Ecuador must be updated.
