Abstract
This scientific article analyzes the regulatory conflict that arises between Article 5
of the Municipal Gazette No. 4, dated August 1, 2023, "Municipal ordinance
amending and coding the ordinance that creates and regulates the integrated urban
mass transportation system of the city of Guayaquil - Metrovía System" "Entry into
the exclusive lane of the Metrovía rapid transportation system", and Article 391,
paragraph 3 of the "Comprehensive Organic Criminal Code (COIP) "The driver
who invades with his or her vehicle the exclusive lanes assigned to rapid
transportation buses." This article examines the normative hierarchy within the
Ecuadorian legal system, the principle of legality and favorableness, and the
normative jurisdiction between the Decentralized Autonomous Municipal
Government of Guayaquil (GADMG) and national legislation. The objective is to
determine which law should prevail when issuing the corresponding sanction for
this type of infraction, and what the legal implications are for citizens.

El presente artículo científico, analiza el conflicto normativo que se genera entre el
artículo 5 Gaceta Municipal # 4 de fecha 1 de agosto del 2023 “Ordenanza
Municipal reformatoria y codificación de la ordenanza que crea y reglamenta el
sistema integrado de transporte masivo urbano de la ciudad de Guayaquil – Sistema
Metrovía” “Ingreso al carril exclusivo del sistema de transportación rápida
Metrovía”, y el artículo 391 numeral 3 del “Código Orgánico Integral Penal (COIP)
“La o el conductor que invada con su vehículo las vías exclusivas asignadas a los
buses de transporte rápido.” Se estudia la jerarquía normativa dentro del
ordenamiento jurídico ecuatoriano, el principio de legalidad y favorabilidad, la
competencia normativa entre el gobierno autónomo descentralizado municipal de
Guayaquil (GADMG) y la legislación nacional. El objetivo es determinar cuál
norma es la que debe de prevalecer al momento de emitir la sanción correspondiente
para este tipo de infracción, y cuáles son las implicaciones jurídicas para los
ciudadanos.
