| dc.description | El presente estudio se enfoca en el análisis del fraude procesal en el marco del Código Orgánico Integral Penal del Ecuador. El objetivo principal de este estudio es examinar los aspectos fundamentales del fraude procesal contemplados en el COIP, así como identificar sus implicaciones y consecuencias en el ámbito jurídico. Se llevará a cabo un análisis exhaustivo de los artículos 284 y 285 del COIP, que tipifican y sancionan el fraude procesal. El estudio se desarrollará mediante una revisión sistemática de la legislación vigente, jurisprudencia relevante y estudios previos sobre el tema. Los resultados obtenidos contribuirán al conocimiento académico sobre el fraude procesal y proporcionarán recomendaciones prácticas para fortalecer la lucha contra esta conducta delictiva. Se espera que este estudio sirva como base para futuras investigaciones y para el diseño de políticas y reformas legales encaminadas a prevenir y sancionar de manera más efectiva el fraude procesal en el contexto ecuatoriano. | |
| dc.description.abstract | This study focuses on the analysis of procedural fraud within the framework of the Integral Organic Criminal Code (COIP) of Ecuador. The main objective of this study is to examine the fundamental aspects of procedural fraud contemplated in the COIP, as well as to identify its implications and consequences in the legal field. An exhaustive analysis of articles 284 and 285 of the COIP will be carried out, which classify and penalize procedural fraud. The study will be carried out through a systematic review of current legislation, relevant jurisprudence and previous studies on the subject. The results obtained will contribute to academic knowledge about procedural fraud in the COIP and will provide practical recommendations to strengthen the fight against this criminal behavior. It is expected that this study will serve as a basis for future research and for the design of policies and legal reforms aimed at preventing and punishing procedural fraud in the Ecuadorian context more effectively. | |
