EL FRAUDE PROCESAL EN EL CÓDIGO ORGÁNICO INTEGRAL PENAL ECUATORIANO

Abstract

This study focuses on the analysis of procedural fraud within the framework of the Integral Organic Criminal Code (COIP) of Ecuador. The main objective of this study is to examine the fundamental aspects of procedural fraud contemplated in the COIP, as well as to identify its implications and consequences in the legal field. An exhaustive analysis of articles 284 and 285 of the COIP will be carried out, which classify and penalize procedural fraud. The study will be carried out through a systematic review of current legislation, relevant jurisprudence and previous studies on the subject. The results obtained will contribute to academic knowledge about procedural fraud in the COIP and will provide practical recommendations to strengthen the fight against this criminal behavior. It is expected that this study will serve as a basis for future research and for the design of policies and legal reforms aimed at preventing and punishing procedural fraud in the Ecuadorian context more effectively.
