Abstract

Judgment No. 53-20-JH/22 of the Constitutional Court of Ecuador, issued in Case No. 53-20-JH and known as the "Mona Estrellita" Case, set a revolutionary precedent in how nature is evaluated as a subject of rights, especially when its individual elements—which may be wild animals—become the object of protection and, in turn, its recipient, which generates conflict with the rights of individuals. Through a qualitative, hermeneutic study based on a bibliographic review and the exegesis of the Judgment, this work seeks to systematize the normative and jurisprudential criteria related to the individual recognition of wild animals as subjects of law in Ecuador. The analysis generates a proposal for regulatory reform that takes this perspective into account. Specifically, it is considered that wild animals are subjects of individual rights and must be protected from threats in any form, whether in their natural habitat, simulated habitat, or if they are domesticated. Furthermore, the protection action is considered appropriate for claiming violations of their rights.
