EXENCIONES DEL IMPUESTO A LA RENTA Y EL PRINCIPIO DE EQUIDAD TRIBUTARIA EN ECUADOR

Abstract

Tax exemptions are fiscal policies designed to advance economic, social, and redistributive objectives; however, they are not always applied effectively or equitably among taxpayers within the tax system. Accordingly, this research analyzed the Income Tax exemptions established in Articles 9, 9.1, 9.2, and 9.3 of the LRTI and their impact on upholding the principle of tax equity in Ecuador. The study employed a qualitative, documentary, and legal approach, utilizing an analytical-synthetic and hermeneutic framework grounded in constitutional provisions, statutes, legal doctrine, and specialized literature. The results indicate that Income Tax exemptions serve a legitimate purpose within the fiscal system; however, Ecuador lacks a systematic, periodic evaluation of these benefits to determine whether they actually foster tax equity or create differential treatment lacking a basis in the principle of equality. Therefore, it is essential to implement measures for continuous monitoring and evaluation to promote transparency, tax justice, and legal certainty in the application of such exemptions.
