Abstract
Search and seizure is a legally established procedural figure in Ecuador,
governed by Articles 480, 481, and 482 of the Comprehensive Organic Criminal
Code (COIP), constituting a fundamental tool for all types of pre-procedural and
procedural criminal investigations. However, its execution has evidenced a serious
legal problem: the disclosure of information, images, and videos obtained during
the operation violates the constitutional rights of the person subjected to the search,
including their dignity, good reputation, and presumption of innocence, as
recognized in Article 66, numerals 18 and 20, and Article 76 of the Constitution.
Article 178 of the COIP, which criminalizes the violation of privacy, presents a
regulatory gap by failing to specifically contemplate this scenario, consequently
allowing those who disclose the operation to remain unpunished. Through a
qualitative and legal approach, applying analytical-descriptive and dogmatic-legal
methods, this paper identifies said gap and proposes the incorporation of an
unnumbered clause to Article 178 of the COIP that sanctions with deprivation of
liberty from three to five years any person who discloses information obtained
during the execution of a search and seizure.
