Abstract

The rise of influencers and content creators who advertise brands and products on social media platforms has generated favorable conditions for deceptive advertising, particularly in the nutritional and aesthetic sectors, where content creators promote miraculous health products or, alternatively, omit disclosing the commercial nature of their publications. In response to this issue, Ecuador enacted the Organic Law Regulating Unfair Competition (LORCCD) (by its Spanish acronym), in August 2025. classifies acts of deception, as well as misleading or covert advertising, as sanctionable offenses. Through a dogmatic legal analysis, this study examines the principles of good faith and transparency, the typicality of disloyal conduct in digital environments, and the powers vested in the Superintendency of Economic Competition. The findings reveal that, although the LORCCD represents a meaningful regulatory advance, its effectiveness against influencers remains limited, given that it neither expressly defines the concept of content creator nor establishes technical parameters to distinguish personal opinion from sponsored messaging, nor does it provide mechanisms for digital auditing or the preservation of ephemeral evidence. Consequently, administrative oversight proves essentially reactive, contingent upon the issuance of the pending implementing Regulation.
