Abstract
This research addresses the phenomenon of the “de-objectification” of animals within the Ecuadorian legal system and its effects on civil property law. It is neces-sary to determine the patrimonial consequences that arise when animals are no longer viewed exclusively as property – in a context where the Constitution and case law already recognize them as sentient beings and subjects of rights – even though civil law retains its traditional categories based on the concept of movable property. The objective is to analyze whether this process of legal reconfiguration generates patrimonial effects that are consistent with the structure of private law in Ecuador. Methodologically, the study adopts a qualitative, doctrinal-legal approach based on a documentary analysis of legal theory, legislation, and both national and comparative case law. The results demonstrate that the current civil law classifica-tion of animals is inadequate considering their constitutional recognition, particu-larly regarding the criterion of sentience. Legal tensions exist concerning owner-ship, possession, civil liability, and the transfer of property; consequently, it is nec-essary to incorporate limits based on socio-environmental function and animal wel-fare criteria into the exercise of ownership rights and legal acts involving animals.
