Abstract

This article examines the legal conflict between the right of children and adolescents to be heard and the principle of non-revictimization in Ecuador. It argues, from doctrinal, constitutional, and jurisprudential perspectives, that both principles are complementary within the context of the best interests of the child and are not mutually exclusive. The right to be heard is an essential component of due process and an important guarantee for more legitimate judicial decisions that are better suited to the realities of children and adolescents. However, problems persist in judicial practice stemming from restrictive or formalistic interpretations, as well as a lack of standardized protocols. Simultaneously, the principle of non-revictimization aims to prevent children and adolescents from being repeatedly exposed to traumatic circumstances; however, its excessive application could lead to the child's exclusion from the process. In this situation, the article suggests implementing methods of protected participation, such as one-off interviews and the use of specialized instruments, to reconcile both principles and ensure comprehensive and effective judicial protection.
