Abstract
The accelerated development of neurotechnologies raises unprecedented constitutional challenges for mental privacy and cognitive liberty. The possibility of capturing neural signals, producing inferences about mental states, and using neurocognitive profiles requires assessing whether the Ecuadorian legal framework sufficiently protects the mental sphere. This research, based on a qualitative, doctrinal, jurisprudential, and comparative legal approach, examines the Constitution, the Organic Law on Personal Data Protection, constitutional precedents on habeas data and privacy, international standards, and the Chilean experience. The study addresses whether existing guarantees are sufficient to prevent harms that may occur before any visible clinical injury. It concludes that Ecuador has normative grounds for initial protection, but lacks a preventive and operational standard regarding neurodata, inferences, and consent in asymmetric relationships. Therefore, it proposes recognizing neurorights as projections of existing rights, incorporating enhanced consent, impact assessment, neurosecurity, sectoral limits, and a progressive regulatory roadmap. These measures seek to provide an immediate and coherent constitutional response.
