Abstract
This article analyzes the administrative delays by the National Service for Comprehensive Care of Adults Deprived of Liberty and Juvenile Offenders (SNAI) in executing release orders for pretrial detention. Although Article 534 of the Code of Criminal Procedure (COIP) and Article 77(4) of the Constitution mandate immediate release, prison practices reveal delays that keep defendants in custody without a conviction. To address the issue of the violation of the right to liberty by the National Service for Comprehensive Care of Adults Deprived of Liberty and Juvenile Offenders (SNAI) during the release phase, it is essential to analyze the regulatory framework, institutional assessments, and the issues identified in the 2022–2025 Public Policy on Social Rehabilitation document. Through a qualitative approach and a documentary analysis of the Regulations of the National Social Rehabilitation System, the Public Policies on Social Rehabilitation 2022–2025, and the SNAI Manual on the Promotion and Protection of Human Rights, it is evident that these delays constitute arbitrary detention and violate the right to personal liberty. It is concluded that the lack of clear protocols and the SNAI’s internal bureaucracy give rise to state liability for failure to comply with constitutional and international human rights standards.
