Abstract
This study focuses on the need to establish minimum standards for the application of
indigenous justice to individuals who do not belong to the communities, in the context of the
legal pluralism that distinguishes the Ecuadorian State. Although the Constitution recognizes
indigenous jurisdiction, the Constitution does not recognize indigenous jurisdiction as valid
within the community territory, the absence of coordination legislation generates regulatory
gaps that cause tensions, especially when conflicts involve individuals not belonging to said
communities, the study examines how the principle of territoriality, the basis of the legitimate
exercise of indigenous justice, is compromised when events or people transcend the recognized
geographical limits, in addition, the risks of affecting fundamental rights are identified when
customary sanctions are applied. without guaranteeing informed consent or due process to
external subjects; Through a normative and jurisprudential analysis, guidelines are presented
that aim to reconcile respect for indigenous autonomy with the safeguarding of human dignity,
highlighting the importance of precisely delineating the territorial and personal domain of
indigenous jurisdiction. The study concludes that the strengthening of intercultural dialogue
and the enactment of coordination legislation are essential elements to achieve harmonious
coexistence between diverse legal systems.
