Abstract

This paper analyzes the effective application of the best interests of the child in Judgment No. 95-18-EP/24 of the Constitutional Court of Ecuador, which examined the merits of the case to address the shortcomings of the decisions of the lower court and the appeal that did not adequately resolve the violation of constitutional rights. Through a qualitative study that utilized documentary review and analysis-synthesis methods, a critical reflection of the aforementioned Judgment was carried out, concluding that the protection of the best interests of the child in this case was not effective, considering the delay in resolving the matter and that, due to the nature of the measures adopted, the full substantive and procedural dimension of said principle was not achieved.
