EL VACÍO LEGAL DE LA MICROMOVILIDAD ELÉCTRICA EN ECUADOR: ANÁLISIS DE LA SEGURIDAD JURÍDICA

Abstract

Micromobility is an alternative form of urban transportation that, although envi-ronmentally friendly, requires both infrastructure and regulatory adjustments. The challenge in Ecuador is heightened by the absence of a legal regulatory frame-work, which leaves comprehensive regulation in the hands of municipal govern-ments. In this context, the present study aims to analyze the legal effects of legis-lative anomies on micromobility in relation to the State’s sanctioning power and administrative traffic‑control capacity. Through a qualitative study supported by the analysis–synthesis method and documentary review techniques, it was found that legislative anomie regarding micromobility in Ecuador creates limitations in regulation, oversight, and enforcement. In summary, the study concludes that there are significant challenges for municipal decentralized autonomous govern-ments in planning and adopting the corresponding ordinances, making it neces-sary for regulations to be adapted to local characteristics and to the legal‑regula-tory capacities of each jurisdiction
