Abstract
Ecuador has endeavoured to include in its laws various guarantees to protect the
rights to integrity and non-discrimination on the grounds of judicial status of
persons deprived of liberty and those with released status; however, for those
people who, although they have been immersed in criminal proceedings, have not
been determined any criminal responsibility, no clear and applicable regulations
have been established aimed at protecting and guaranteeing their rights to honor,
good name and non-discrimination due to judicial past.
Therefore, through a descriptive and explanatory methodology, the regulations,
resolutions and guidelines issued in relation to the subject in question will be
analyzed, including those signed by the administrative authorities of the Council
of the Judiciary, in order to demonstrate the existence of certain legal gaps and
incompatibility of regulations, that generate damage, confusion and possible
violation of the constitutional rights of honor, good name and non-discrimination
due to judicial past.
Description
El Ecuador ha procurado incluir en sus leyes, diferentes garantías para precautelar
los derechos de integridad y no discriminación por pasado judicial de las personas
privadas de libertad y con estatus de liberado; sin embargo, para aquellas personas
que, si bien se han encontrado inmersas en procesos penales, no se les ha
determinado ninguna responsabilidad penal, no se ha establecido normativa clara
y aplicable, destinada a la protección y garantía de sus derechos al honor, buen
nombre y no discriminación por pasado judicial.
Por lo tanto, a través de una metodología descriptiva y explicativa, se analizará la
normativa, resoluciones y directrices emitidas con relación al tema en cuestión,
inclusive aquellas suscritas por las autoridades administrativas del Consejo de la
Judicatura, con el fin de evidenciar la existencia de ciertos vacíos legales e
incompatibilidad de normativas, que generan perjuicio, confusión y posible
vulneración a los derechos constitucionales de honor, buen nombre y no
discriminación por pasado judicial
