Abstract
This research analyzes free, Prior and Informed Consultation (FPIC) in Ecuador, focusing on the regulatory gaps that hinder its effective implementation despite its recognition in the 2008 Constitution (Arts. 57.7 and 398), the ILO Convention 169, and the jurisprudence of the Inter-American Court of Human Rights (IACtHR). Through a legal analysis, the study examines the main shortcomings: the absence of a uniform procedure, lack of clarity regarding the competent authority, uncertainty about 2 the subjects to be consulted, the timing of the process, the scope of the information to be provided, the ultimate purpose of consultation, and sanctions for non-compliance. It also explores the incidences of these gaps, such as legal uncertainty, recurrent judicialization, violations of collective rights, and the risk of international condemnations. Finally, it proposes normative and institutional recommendations to strengthen FPIC as a fundamental guarantee for indigenous peoples and nationalities, in line with constitutional and international standards.
