Abstract
The present paper exposes the relationships and legal tensions that exist between the Constitutional
State of Rights and Justice declared in the Constitution of Ecuador of 2008, the monetary system
of dollarization in force since January 9th, 2000, and the relevant observed fact of the Ecuadorian
State public over-indebtedness. In Ecuador, the Constitutional State of Rights and Justice is based
on three pillars: 1) A material and rigid Constitution; 2) a Constitution with a normative and
binding nature and 3) a Constitution that has a specialized institution for judicial control of
constitutionality with the ability to interpret the Constitution. As will be analyzed below the
challenge posed to the Constitutional State of Rights and Justice, under the rule of an infraconstitutional
norm such as the regulations that declare the United States dollar as the legal tender
means of payment in the Republic of Ecuador, will be to guarantee, without any discrimination,
the effective enjoyment of the rights established in the Constitution and international instruments,
particularly in education, health, food, social security and water for the population
