Abstract
The present investigation revises the reason why arbitrary administration acts in reference to the application of articles 273 and 360 of the Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación limits the exercise of legal security and freedom of enterprise, especially, when set arbitrary act is found in the cases when the Servicio Nacional de Derechos Intelectuales -SENADI- denies the registration of a brand or patent based upon legislation that has unprecise, ambiguous and subjective elements. The primary method used to develop this article was the inductive method, applying qualitative techniques of document analysis, mostly regarding the Constitución de la República del Ecuador, the Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, the Código Orgánico Administrativo, among others, jurisprudence and pertinent doctrine. In consequence, the existence of negative legal consequences that are provoked by the arbitrary acts coming from SENADI and the impact that they have on freedom of enterprise and legal security

En el presente artículo se revisa por qué la arbitrariedad administrativa referente a la aplicación de los artículos 273 y 360 del Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, que limita el ejercicio de la seguridad jurídica y la libertad de empresa, en especial, cuando dicha arbitrariedad se presenta cuando el Servicio Nacional de Derechos Intelectuales -SENADI- niega de manera absoluta un registro de marcas y patentes conforme unas disposiciones normativas que presentan elementos imprecisos, ambiguos y subjetivos. Para desarrollar este trabajo se utilizó, mayoritariamente, el método inductivo, empleando técnicas cualitativas de análisis documental, sobre todo respecto de la normativa vigente, como la Constitución de la República del Ecuador, el Código Orgánico de la Economía Social de los Conocimientos, Creatividad e Innovación, el Código Orgánico Administrativo, entre otros, la jurisprudencia y la doctrina pertinente. En consecuencia, se determinó las consecuencias jurídicamente negativas que provoca la actuación arbitraria del Servicio Nacional de Derechos Intelectuales -SENADI- y el impacto que tiene en relación con la libertad de empresa y la seguridad jurídica.
