Abstract
The general objective of this study was to analyze Resolution 12-2025 regarding alimony rights, as it establishes clear requirements for the defendant, but lacks fixed regulations for the plaintiff when requesting alimony when the plaintiff has a disability. A mix approach was used, employing analytical methods and using bibliographic references such as articles, journals, and legal documents. And quantitative methods like the questionnaire. Furthermore, the regulatory inequality among alimony recipients can be observed.

En este presente estudio se expuso como objetivo general analizar la Resolución 12-2025 respecto al derecho alimentario ya que existe una asimetría normativa en el que se establecen requisitos claros para el sujeto demandado, pero no existen normativas fijas para el sujeto demandante a la hora de solicitar pensión alimenticia cuando el demandante posee una discapacidad. Para ello se ha utilizado un enfoque mixto ya que se emplean métodos de análisis, usando a su vez referencias bibliográficas como artículos, revistas y documentos legales. Y métodos cuantitativos como la encuesta. Además, se puede observar la desigualdad referente a la normativa entre los beneficiarios de la pensión alimenticia.
