After identifying that the Ecuadorian legal framework lacks specific mechanisms to prevent, detect, and penalize digital identity theft carried out via generative arti-ficial intelligence and the manipulation of synthetic biometric data, this research was conducted to analyze the adequacy of Ecuadorian legal safeguards in this area. The aim was to identify regulatory gaps and propose legal mechanisms to strengthen protection. Through a qualitative study employing the inductive-deduc-tive method and a documentary review, it was found that the technical architecture of generative artificial intelligence dilutes classical principles regarding the attrib-ution of legal liability. The study concludes that the current legal framework has limited effectiveness against biometric fraud due to issues concerning the defini-tion of offenses and administrative jurisdiction. Furthermore, judicial safeguards prove unfeasible given the absence of a centralized database or an identifiable de-fendant within encrypted networks, and the crime of identity theft fails to protect against the algorithmic instrumentalization of generative artificial intelligence; all of which underscores the need for legal reforms in these areas
