CAPACIDAD ECONÓMICA DEL ALIMENTANTE FRENTE AL INTERÉS SUPERIOR DEL NIÑO EN PENSIÓN ADICIONAL EN ECUADOR

Abstract

The right to child support in Ecuador guarantees that children and adolescents re-ceive the necessary resources for their integral development. Within this system, the Code of Children and Adolescents establishes an additional payment in April for the Coastal region and in September for the Sierra and Amazon regions, aimed at covering school-related expenses at the beginning of the academic year. How-ever, when the established pension exceeds the Unified Basic Remuneration or when the obligor lacks stable income, a tension arises between the best interests of the child and the actual economic capacity of the provider. The accumulation of arrears and the enforcement of coercive measures reveal that the obligation loses effectiveness when it becomes materially impossible to fulfill. The analysis exam-ines criteria of proportionality, sustainability, and judicial reasoning, as well as the need to adjust the interpretation of the additional payment to prevent it from be-coming an irrational burden. The objective is to determine whether the current model effectively guarantees the protection of the child or whether differentiated criteria are required to ensure that the child support obligation is sustainable and genuinely effective.
