Abstract
The protection of personal data in this case linked to intimate images is a fundamental right that in the Ecuadorian legal system is in the process of formation and evolution. As such, it is necessary to study each of the contexts and dimensions to understand how the scope of protection of this right is established. In this case, the protection of intimate images is a recent issue within the sphere of Ecuadorian constitutional law, so it is necessary to visualize its characteristics and areas of protection. The present study shows how habeas data can serve as a significant means of protection of this type of images as part of personal data. Ruling No. 2064-14-EP/21 of the Constitutional Court expands and describes the dimensions of the right to protection of personal data, especially regarding intimate photos. As a result of this investigation, it is recognized that personal data and intimate images have an important constitutional protection mechanism to the extent that they allow the identification of the person, have sensitive information and that their access and circulation does not proceed with the consent of its owner.

La protección de datos personales en este caso ligado con las imágenes intimas es un derecho de carácter fundamental que en el ordenamiento jurídico ecuatoriano se encuentra en proceso de formación y evolución. En tal virtud es necesario estudiar cada uno de los contextos y dimensiones para comprender cómo se establece el ámbito de tutela de este derecho. En este caso, la protección de las imágenes íntimas es de cuestión reciente dentro de la esfera del derecho constitucional ecuatoriano, por lo que se requiere visualizar sus características y ámbitos de protección. El presente estudio muestra cómo el hábeas data puede cumplir como un significativo medio de tutela de este tipo de imágenes como parte de los datos personales. La Sentencia N° 2064-14-EP/21 de la Corte Constitucional amplía y describe las dimensiones del derecho a la protección de datos personales en especial sobre las fotos íntimas. Como resultado de esta investigación se reconoce como los datos personales y las imágenes íntimas cuentan con un importante mecanismo de protección constitucional en la medida que estas permitan la identificación de la persona, dispongan de información de carácter sensible y que su acceso y circulación no proceda con el consentimiento de su titular.
