Abstract

This thesis examines the difficulties faced by the Ecuadorian system in achieving effective collection of child support. In practice, existing patrimonial measures such as the prohibition on the disposal of assets do not always fulfill their intended purpose, since in many cases they end up freezing the obligor's assets without generating immediate liquidity for the minor. This problem reveals a contradiction within the procedural system itself: while the aim is to secure compliance with the obligation, the very mechanisms that would allow for the rapid recovery of funds are restricted. As a result, the right to child support loses effectiveness, undermining both the principle of effective judicial protection and the principle of the best interests of the child. The study argues for the need to rethink the current approach. Rather than reinforcing traditional measures, proposes incorporating alternative mechanisms that directly influence the debtor's behavior. These include restrictions of a civil, social, and administrative nature that do not impair the obligor's capacity to generate income, but affect their everyday circumstances. In this sense, the research concludes that a model based on functional measures—rather than exclusively patrimonial ones—could yield better results, by incentivizing compliance without hindering the obligor's economic activity.
