| dc.description | La Corte Constitucional emitió la sentencia 1758-15-EP/20 por una acción extraordinaria de protección presentada en contra de sentencias emitidas dentro del marco de un proceso de consumo, en donde ambos jueces de instancia declararon como nula una cláusula arbitral dentro de un contrato de adhesión. En la sentencia, la Corte Constitucional realiza un análisis de oficio de la capacidad de los jueces ordinarios para decidir sobre la validez y alcance de los convenios arbitrales a la luz de los principios kompetenz-kompetenz y pro arbitri. El presente artículo revisa conceptos relacionados con el Derecho del consumidor, el arbitraje y como se relacionan ambos, tomando en cuenta ejemplos de legislaciones extranjeras. Finalmente, se revisará la sentencia de la Corte Constitucional a efectos de determinar si existen o no afectaciones a los derechos de los consumidores. | |
| dc.description.abstract | The Constitutional Court issued sentence 1758-15-EP/20 regarding an extraordinary protection action against sentences issued in the context of a process of consumer protection rights, in which both judges declared the annulment of an arbitration clause inserted in an adhesion contract. The sentence analyses ex officio the capacity of the ordinary judges to decide about the validity and reach of the arbitration clauses under the light of the kompetenz-kompetenz and pro arbitri principles. This article investigates concepts related to Consumer Rights, Arbitration and how they both relate, considering examples from foreign legislatures. Finally, we will look into the sentence issued by the Constitutional Court to the effect of finding out if there are or aren’t transgressions against Consumer Rights. | |
