This study analyzes the crime of cattle rustling as provided in Article 199 of Ecuador’s Comprehensive Organic Criminal Code (COIP), aiming to identify its normative limitations and the need to broaden its legal definition. Currently, the law penalizes the unlawful appropriation of major or minor livestock, without clearly defining which species are included under this category. This lack of clarity creates legal loopholes and leaves several economically important animals—such as goats, guinea pigs, fish, and bees—outside the scope of criminal protection. Such ambiguity undermines the principle of legality and limits the effective application of the criminal offense, particularly in rural settings, where cattle rustling is a recurring crime that affects the assets of small-scale producers and Indigenous communities. Through doctrinal, normative, and comparative analysis, the study highlights the urgent need for legal reform that includes a broader and more inclusive definition of the protected legal interest. A modification to Article 199 of the COIP is proposed to explicitly recognize other animal species of economic and cultural value, ensuring a fairer and more effective protection that aligns with the country’s social and agricultural realities. This research seeks to contribute to the strengthening of criminal law in Ecuador.
