The advancement of information and communication technologies has profoundly transformed the methods of collecting, preserving, and presenting evidence within criminal proceedings. In the Ecuadorian context, although the legal framework includes some normative references that allow the use of digital evidence, there is still no specific, detailed, and technically sound regulation that fully guarantees its validity and procedural effectiveness in criminal law. This normative gap creates uncertainty for both justice operators and procedural parties, especially regarding the admissibility, authenticity, integrity, and evaluation of such evidence. In a scenario where cybercrimes and the use of digital means as channels of proof are increasingly frequent, legislative reform is essential to meet the challenges of the digital environment. This paper aims to analyze the current treatment of digital evidence in Ecuadorian legislation, identify existing legal gaps, and reflect on the main challenges faced by the justice system in this area.
