| dc.description | Este artículo académico aborda la problemática de la finalización del pago de la pensión de montepío para el cónyuge sobreviviente al contraer un nuevo matrimonio o una unión de hecho en Ecuador. Se plantea un conflicto entre el Reglamento Régimen de Transición Seguro Vejez y Muerte emitido por el IESS y la Ley de Seguridad Social, que no contempla dicha terminación de derechos. Se discute la validez y aplicabilidad del reglamento y se destaca la importancia de determinar la justificación y proporcionalidad de la apropiación de los aportes por parte del IESS, en relación con la posible violación de la prohibición de confiscación establecida en la Constitución. Se insta a los beneficiarios a buscar asesoramiento legal y presentar reclamaciones ante las autoridades competentes para proteger sus derechos. | |
| dc.description.abstract | This academic article addresses the issue of terminating the payment of montepío pension for the surviving spouse upon entering a new marriage or de facto union in Ecuador. It raises a conflict between the Transition Regime Regulation for Old Age and Death Insurance issued by the IESS and the Social Security Law, which does not contemplate such termination of rights. The validity and applicability of the regulation are discussed, and the importance of determining the justification and proportionality of the appropriation of contributions by the IESS is emphasized, in relation to a possible violation of the prohibition of confiscation established in the Constitution. Beneficiaries are urged to seek legal advice and file complaints with the competent authorities to protect their rights. | |
