ANÁLISIS DEL ESTÁNDAR DE PRUEBA Y SU VALORACIÓN EN MATERIA DE GARANTÍAS JURISDICCIONALES A PARTIR DE LA SENTENCIA N.º 2951-17-EP/21 DE LA CORTE CONSTITUCIONAL DEL ECUADOR

Abstract

This paper addresses the criterion of flexibility implicit in the standard of assessment of the test of greater probability in the processes of jurisdictional guarantees according to the pronouncement of the Constitutional Court of Ecuador in judgment No. 2951-17-EP/21. Through the documentary review carried out, the most relevant positions and contributions of various jurists in the face of the problem raised are exposed, highlighting the function of the evidentiary standards within the judicial process, the shortcomings of a flexibility of the evidentiary activity and its repercussion on the judicial decision in the face of the possible violation of a constitutional right. Likewise, the need to promote specific guidelines for the evidentiary activity of constitutional protection processes is emphasized. Finally, among the conclusions, it is determined that the pronouncement of the Constitutional Court regarding how the evidence should be evaluated in this matter is not sufficiently clear or objective. Therefore, it is suggested that within the Ecuadorian legal system the application of the standard of proof of greater probability is regulated, which implies its formulation according to rational criteria that justify the degree of corroboration provided by the means of evidence.
