| dc.description | En el presente trabajo se analiza el principio de subsidiariedad y su aplicación en el contexto de la responsabilidad extracontractual del Estado por falla del servicio. El análisis de ambos conceptos se ejecuta inicialmente a través del método deductivo, partiendo de una premisa general como la delegación de competencias, hasta llegar a determinar el alcance de la satisfacción del ejercicio pleno de los derechos fundamentales pertinentes. Se aplica la técnica cualitativa de revisión documental para identificar los conceptos clave sobre la problemática, concluyendo que el Estado ecuatoriano no puede estar exento de responsabilidad aun cuando haya delegado el ejercicio de sus competencias, ya que ocupa un rol de garante ante el cumplimiento de los derechos del buen vivir. | |
| dc.description.abstract | This paper analyzes the principle of subsidiarity and its application in the context of the State's extracontractual liability for service failure. The analysis of both concepts is initially carried out using the deductive method, starting from a general premise such as the delegation of powers, and progressing to determine the scope of ensuring the full exercise of the relevant fundamental rights. The qualitative technique of documentary review is applied to identify key concepts related to the issue, concluding that the Ecuadorian State cannot be exempt from liability even when it has delegated the exercise of its powers, as it plays a guarantor role in ensuring the fulfillment of the rights to a good life. | |
