This research analyzes the viability of mediation as an effective alternative for divorce by mutual consent in Ecuador. Despite its sucres in resolving family conflicts in various countries, mediation has not yet been recognized as an autonomous pathway for this type of process. Employing a mixed-methods approach, the study identifies the normative, operational, and social barriers that hinder its implementation. Through a comprehensive examination of current regulations, interviews with family law experts and certified mediators, as well as a comparative analysis with international models, it is demonstrate that mediation can alleviate the judicial burden, expedite processes, and minimize the emotional impact on the parties involved. The results suggest that, with the necessary reforms to the Civil Code, the Organic General Code of Processes, and the Arbitration and Mediation Law, mediation could establish itself as a legally valid and efficient option for managing divorce by mutual consent.
