This study addresses the right of children and adolescents to be heard in family law proceedings, highlighting the gap between legal recognition and actual implemen-tation in Ecuador. Its primary objective is to analyze the legal and substantive con-ditions that determine the effective guarantee of this right within the Ecuadorian legal system. The study employs a qualitative approach, utilizing analysis-synthesis and document analysis methods to effectively combine a review of legal norms, legal doctrine, and case law. Findings reveal significant judicial discretion and a lack of technical protocols for private hearings in family law proceedings, factors that limit the participation of children and adolescents in the judicial process. The study proposes a technical protocol to establish the framework for such hearings and recommends its approval by the Judicial Council, mandating its implementa-tion in family law proceedings.
