| dc.description | El avance tecnológico ha permitido desarrollar nuevos mecanismos alternativos de resolución de conflictos, como el Online Dispute Resolution (ODR) herramienta que brinda una plataforma virtual para resolver los Alternative Dispute Resolution (ADR) con la aplicación de la inteligencia artificial. Actualmente, en el Ecuador se desarrollan los MASC de forma tradicional, ya que la Ley de Arbitraje y Mediación no abarca el sistema ODR como una figura jurídica dentro del marco legal vigente. Siendo esta herramienta, una alternativa innovadora dotada de inteligencia artificial, que resuelve algorítmicamente las disputas online. En la actualidad, existen proveedores multinacionales, como EBay, Amazon y Alibaba que utilizan el sistema ODR, quienes garantizan a los usuarios una transacción comercial segura, eficiente y menos engorrosa, comparado con los sistemas convencionales de resolución de disputas. Por ello, el presente trabajo tiene como finalidad impulsar la adaptación del sistema ODR en el Ecuador, mediante el desarrollo de los fundamentos técnicos y jurídicos que validen su implementación. | es |
| dc.description.abstract | The technological advance has allowed the development of new alternative mechanisms for conflict resolution, such as the Online Dispute Resolution (ODR) tool that provides a virtual platform to solve the Alternative Dispute Resolution (ADR) with the application of artificial intelligence. Currently, in Ecuador, MASC are developed in a traditional way, since the Arbitration and Mediation Law does not cover the ODR system as a legal entity within the current legal framework. Being this tool, an innovative alternative equipped with artificial intelligence, algorithmically resolves online disputes. At present, there are multinational suppliers, such as EBay, Amazon and Alibaba that use the ODR system, which guarantee users a safe, efficient and less cumbersome commercial transaction, compared with conventional dispute resolution systems. Therefore, the purpose of this paper is to promote the adaptation of the ODR system in Ecuador, through the development of the technical and legal foundations that validate its implementation. | es |
