| dc.description | La presente revisión se enfoca en la potestad que tiene el Estado para aprobar las integraciones empresariales, y la tensión que el ejercicio de esta provoca en las libertades de empresa, de asociación y de competencia, bajo la regulación de la Ley Orgánica de Control del Poder de Mercado. Partiendo de un enfoque racionalista, a través del método inductivo y el uso de técnicas cualitativas, expone la regulación actual para las integraciones empresariales y el procedimiento previo a su autorización. Se presenta un caso considerado como un abuso de las potestades públicas por parte del órgano de control, que distorsiona la garantía de ejercicio pleno establecida a favor de las libertades que se revisa. | es |
| dc.description.abstract | The present review focuses on the power that the State has to approve the business integrations, and the tension that the exercise of this causes in the freedoms of company, association and competition, under the regulation of the Organic Law of Power Control of Market. Starting from a rationalist approach, through the inductive method and the use of qualitative techniques, he exposes the current regulation for business integrations and the procedure prior to their authorization. A case considered as an abuse of the public powers by the control body is presented, which distorts the guarantee of full exercise established in favor of the liberties that are reviewed. | es |
