Within the Ecuadorian legal context, parents who have minor children under their care and wish to marry, whether for the first or second time with a person other than the other parent, require a special curator under Article 131 of the Civil Code if the child has assets to be administered. However, Article 132 of the same legal body extends this obligation even when no assets exist, generating a normative extension devoid of legal logic by imposing a measure without any patrimonial object to protect. The legal problem lies in the fact that this extension distorts the purpose of the special curatorship, turning it into a formality lacking practical utility. Furthermore, the terminology linked to "second nuptials" is outdated in relation to current social reality. This qualitative research shows that Article 132 imposes an unnecessary burden based on an abstract presumption. It is concluded that this provision lacks normative coherence; therefore, its reform is justified to replace it with a notarized sworn statement when there is an absence of assets.
