| dc.description | El estudio se enmarcó en el análisis de sentencias sobre el incumplimiento de decisiones legítimas de autoridad competente, tomando énfasis en el debido proceso del mismo, pero que algunos jueces de primer nivel a criterio del autor se van direccionando al hecho de un incumplimiento de una orden judicial mas no de la autoridad competente. El objetivo del paper fue evidenciar el proceder de autoridades competentes cuando dan un fallo por incumplimiento de decisiones legítimas, teniendo en cuenta que lo que se juzgo fue otro delito, por ello la metodología aplicada fue de carácter cualitativa de alcance descriptivo, la parte referencial se fundamentó en la revisión de leyes y cuerpos jurídicos que se han referido en este paper. De lo investigado se visualiza que el debido proceso es la columna principal de la normativa legal, en ella se cumplen principios de la legalidad y legitimidad, más sin embargo cuando este se enmarca en un delito y su fin es castigar otro, una de las partes procesales podría pedir la nulidad del mismo, es así que con el presente paper se trato de poner en evidencia el actuar de algunos jueces de primer nivel y que se hagan las correcciones respectivas. | |
| dc.description.abstract | The study was framed in the analysis of sentences on the non-compliance of legitimate decisions of competent authority, emphasizing the due process of the same, but that some first level judges in the author's opinion are directed to the fact of non-compliance of a court order but not of the competent authority. The objective of the paper was to demonstrate the procedure of competent authorities when they give a ruling for non-compliance of legitimate decisions, taking into account that what was judged was another crime, therefore the methodology applied was of a qualitative nature of descriptive scope, the referential part was based on the review of laws and legal bodies that have been referred to in this paper. From what has been investigated, it can be seen that due process is the main pillar of the legal regulations, in which principles of legality and legitimacy are complied with, however, when this is framed in a crime and its purpose is to punish another, one of the procedural parties could ask for the nullity of the same. | |
