VACÍO NORMATIVO EN VERIFICACIÓN DE PODERES APOSTILLADOS: IMPACTO EN SEGURIDAD JURÍDICA ECUATORIANA

Abstract

This paper analyzes the limitations of the 1961 Hague Convention regarding the verification of apostilled powers of attorney granted by Ecuadorian migrants, particularly in the United States. While the apostille facilitates the circulation of documents, it only certifies the signature and the issuing authority, not the content of the power of attorney. In Ecuador, notarial practice is often limited to reviewing the document's form, without additional controls to truly protect the grantor. Through regulatory analysis, interviews, and a review of real cases, a clear regulatory gap is identified: there is no mandatory transnational verification protocol. This omission has allowed for fraud, financial losses, and even risks to minors. This research argues that the State must implement complementary mechanisms that strengthen legal certainty and prioritize the protection of migrants, because streamlining procedures cannot take precedence over protecting rights.
