This research analyzed the role of the indirect perpetrator in organized crime offenses in Ecuador, and the reasons why they benefit from impunity in criminal proceedings for these types of crimes, as they are often not identified by the justice system. The study employed a qualitative methodology, based on its purely theoretical and normative content, with a descriptive and explanatory scope regarding the most relevant theories on this type of perpetration within the categories of authorship stipulated in Article 42 of the Comprehensive Organic Criminal Code. The results showed that the indirect perpetrator enjoys protection from the actions of the justice system, both due to the complexity and vastness of the criminal structure that shelters them through their position of command, and due to normative and investigative deficiencies within the Ecuadorian criminal justice system. It was concluded that this criminal agent is favored by the current design of both criminal organizations and the shortcomings of the justice system, which, if not corrected, will perpetuate that element of impunity known so far in a far-reaching criminal network such as organized crime.
