| dc.description.abstract | The Organic Law of the Entity for Civil Security and Public Order (hereinafter referred to as “COESCOP”) regulates the professional and disciplinary system of the National Police. This study focuses on the analysis of the legal consequences of the early application of Article 129 of the United Nations Convention against Transnational Organized Crime to serious acts of administrative misconduct. COESCOP does not have its own regulations, which are used by the judicial managers of the National Police as supplementary provisions in administrative matters, however, there is a legal gap that needs to be filled by telegrams, which, according to Kelsen’s pyramid structure, cannot be inserted into the Constitution without violating due process, the principles of legality and, in particular, the presumption of innocence. Therefore, this study focuses on the analysis of the serious consequences that would have arisen from the implementation of Article 129 of the United Nations Convention against Transnational Organized Crime in the absence of any clear signs or factors that would indicate the adoption of such drastic measures. These crimes were recorded in their professional records without them having previously proved that they had committed the alleged acts. | |
