In Ecuador, the Comprehensive Organic Criminal Code (Coip) has been in effect since 2014 and, to date, has not included crypto assets among the objects of property crimes. This omission, which has gone largely unnoticed, now causes three types of problems: definitional, typological, and procedural. No article indicates whether virtual assets are included within criminally protected assets. It is also unclear when cryptocurrency fraud should be charged as fraud (Art. 186), as illegal fundraising (Art. 323), or as fraudulent appropriation by electronic means (Art. 190). Adding to this lack of definition is another significant detail: the Coip makes no mention of the digital chain of custody or the expert standards that should be applied to evidence obtained from blockchain. This article addresses, from both a dogmatic and interpretative perspective, the legal framework for crypto assets, the most frequent forms of property fraud, and the practical problems that arise in their investigation. In conclusion, it is determined that: the definitional gap is resolved by carefully reading article 186, while the other gaps call for a clear legislative reform, capable of incorporating virtual assets and providing serious technical instruments for the proof.
