LA SOBREPOSICIÓN EN EL SISTEMA REGISTRAL: SU IMPACTO EN LA SEGURIDAD JURÍDICA Y LA PROPIEDAD

Abstract

This research entitled "Overlap in the Registry System: Its Impact on Legal Security and Property" examines how the overlap of properties in the Property Registry affects legal security in Ecuador, generating uncertainty about property rights. This problem arises due to discrepancies in property records and cadastres, leading to legal conflicts and financial losses for owners. This dilemma is mainly due to the lack of synchronization between land registries and cadastres, which gives rise to legal disputes over who owns the land. The causes of this problem are analyzed, such as the lack of coordination between authorities and the lack of updated registration systems. In addition, solutions are proposed, such as agreements between the parties involved, the implementation of better technological tools, as well as better training of staff to ensure accurate and up-to-date records. These measures aim to protect property rights and increase legal security in the country. The study highlights the importance of an effective and reliable registration system that responds to the modern challenges of urban and rural development.
