| dc.description.abstract | This research addresses the ineffectiveness of administrative sanctions for environmental violations in Ecuador, analyzing the degree to which current sanctioning mechanisms fulfill their preventive, corrective, and deterrent purposes within the environmental protection system. The study arises from the persistence of behaviors that harm the environment despite the existence of a regulatory framework and administrative powers intended for control and sanction. The identified legal problem is to determine whether the administrative sanctions applied in environmental matters are effective in ensuring compliance with regulations and preventing the recurrence of violations, or whether there are regulatory, institutional, or procedural limitations that reduce their impact. The main objective of this research is to analyze the effectiveness of the environmental administrative sanctioning regime in Ecuador and to establish the factors that influence its practical application. To this end, a qualitative methodology will be employed, based on the doctrinal, regulatory, and documentary analysis of legislation, jurisprudence, and academic sources related to environmental law. The scope of the study is descriptive and analytical, focused on the Ecuadorian legal context and on the evaluation of the functioning of the environmental administrative sanctioning system. | |
