IMPLEMENTACIÓN DEL SISTEMA INTERCONECTADO NOTARIAL Y REGISTRAL COMO GARANTIA DE LA LEGALIDAD Y SEGURIDAD JURIDICA

Abstract

A report is drafted that analyzes the importance of an integrated system between notaries and property registries in Ecuador to ensure legal actions and contracts related to property. However, there is limited interaction between the respective institutions, which results in administrative delays and problems in the validation of legal information, and even threats of documentary fraud. By examining Ecuadorian laws—namely the Constitution, the Notarial Law, the Registry Law, the Organic Code of Territorial Organization, Autonomy and Decentralization, and their mechanisms of technological interoperability—it is evaluated whether technological interoperability can be implemented to improve coordination between institutions. The study suggests the digitalization of the system linking notaries with registry offices to facilitate the secure exchange of information, which is an important step toward improving public sector transparency, administrative efficiency, and citizens’ trust in the Ecuadorian registry system.
