This research analyzes the constitutional conflict between procedural speed and the defendant's right to contradiction in child support proceedings within the Ecuadorian legal system. The study recognizes the need to guarantee immediate protection for the beneficiary, especially under the principle of the best interests of the child; however, it also acknowledges that due process requires every person to have a real and effective opportunity to exercise defense. The research argues that procedural speed constitutes a legitimate purpose in child support proceedings, but it cannot justify disproportionate restrictions on the right to contradiction. To achieve this, the study develops a doctrinal and constitutional analysis based on the principle of proportionality and the theory of balancing fundamental rights. Finally, the paper proposes mechanisms of constitutional harmonization aimed at balancing child protection with full respect for due process.
